1. Acceptance of Terms

Welcome to WEGO. By accessing or using our food delivery platform at wegodelivery.app or our mobile applications (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

2. Service Description

WEGO is a food delivery platform that connects customers with local restaurants and delivery drivers. Our services include:

  • Browsing restaurant menus and placing food orders
  • Real-time order tracking and delivery coordination
  • Secure payment processing
  • Customer support for order-related enquiries
  • Restaurant management tools for partner businesses
  • Driver applications for delivery partners

WEGO acts as an intermediary platform. We do not prepare food ourselves. Restaurants are responsible for food preparation, quality, and compliance with food safety regulations. Delivery drivers are responsible for safe and timely delivery.

3. User Accounts

3.1 Account Registration

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Be responsible for all activities that occur under your account

3.2 Account Types

WEGO offers different account types:

  • Customer accounts: For individuals ordering food delivery
  • Business accounts: For restaurant owners and managers
  • Driver accounts: For delivery partners

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise misuse the Platform. You may also delete your account at any time through your account settings.

4. Orders and Payments

4.1 Placing Orders

When you place an order through WEGO:

  • You make an offer to purchase items from the selected restaurant
  • The order is confirmed when the restaurant accepts it and payment is processed
  • Order availability and delivery times are estimates and may vary based on restaurant capacity, weather, and other factors
  • You must provide accurate delivery information

4.2 Pricing and Currency

All prices on WEGO are displayed and charged in Euros (EUR). Prices include:

  • Item prices set by the restaurant
  • Delivery fees (where applicable)
  • Service fees
  • Applicable taxes (VAT)

The total price is displayed before order confirmation. Restaurants may change prices at any time without notice.

4.3 Payment Methods

We accept various payment methods including credit/debit cards and other digital payment options. All payments are processed securely through our payment provider, Stripe. By providing payment information, you authorise us to charge the total order amount to your selected payment method.

4.4 Cancellations and Refunds

Order cancellation policies:

  • Orders can be cancelled before the restaurant confirms and begins preparation
  • Once preparation begins, cancellations may not be possible or may incur fees
  • Refunds for order issues (missing items, quality problems) are evaluated on a case-by-case basis
  • Refunds are processed to the original payment method within 5-10 business days

5. Delivery Terms

5.1 Delivery Areas

Delivery availability depends on your location and restaurant delivery zones. Each restaurant sets its own delivery radius. If your address is outside a restaurant's delivery area, you will not be able to place an order from that restaurant.

5.2 Delivery Times

Estimated delivery times are provided for convenience and are not guaranteed. Actual delivery times may vary due to restaurant preparation time, driver availability, traffic conditions, weather, and other factors beyond our control.

5.3 Delivery Instructions

You are responsible for providing accurate delivery information including:

  • Complete address with apartment/building details if applicable
  • Access instructions (entry codes, building names)
  • A valid phone number for driver contact

5.4 Receiving Orders

You must be available to receive your order at the delivery address. If you are unavailable and the driver cannot complete delivery after reasonable attempts, the order may be marked as undeliverable and you may not be eligible for a refund.

6. User Responsibilities

By using WEGO, you agree not to:

  • Violate any applicable laws or regulations
  • Provide false or misleading information
  • Use the Platform for fraudulent purposes
  • Harass, abuse, or threaten restaurant staff or delivery drivers
  • Interfere with the Platform's operation or security
  • Create multiple accounts to abuse promotions or services
  • Resell or commercially exploit our services without authorisation
  • Attempt to access other users' accounts or data

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of WEGO or its content suppliers and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Platform without our written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • WEGO provides the Platform "as is" without warranties of any kind, either express or implied
  • We are not liable for the quality, safety, or legality of food items prepared by restaurants
  • We are not liable for actions or omissions of restaurants or delivery drivers
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim related to these Terms shall not exceed the amount you paid for the relevant order

These limitations do not affect your statutory rights as a consumer under applicable EU consumer protection laws.

9. Indemnification

You agree to indemnify and hold harmless WEGO, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. Dispute Resolution

If you have a dispute regarding an order or our services:

  • Contact our customer support team first to attempt resolution
  • If we cannot resolve the dispute informally, you may pursue formal dispute resolution
  • As a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

If you are a consumer residing in the European Union, you also benefit from mandatory provisions of the consumer protection laws of your country of residence.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WEGO regarding the use of the Platform and supersede any prior agreements or understandings.
